2022 New EB-5 Law: Top 3 Changes for Investor
The EB-5 Reform and Integrity Act of 2022 brings about a framework shift for the EB-5 Industry.
This videos discusses the Top 3 Changes that will affect investors:
1. Minimum investment amount is not set for the next 5 years until 2027: $800,000 for TEA projects and $1.05M for non-TEA projects.
2. Concurrent filing is now available. This means that EB-5 will become much more attractive to people already in the U.S. on other non-immigrant visas such as F or H-1B.
I note in the video that currently (March 2022) that China and Vietnam is backlogged. But Vietnam may become current (or backlogged) in April depending on how the new visa set-asides (which I don't discuss in the video) are calculated. In other words, concurrent filing may still be available for Vietnamese people already in the U.S. so please check with an immigration attorney!
3. EB-5 investors will no longer have to worry about future Regional Center Program lapses. This will provide more stability and predictability, which will in turn incentivize Regional Centers to bring more projects to the market.

My husband and I are in the US for relocation since June 2018 (I'm L1B, he's L2B).
I am currently in the process of applying for a greencard, however, was told that this will be a long process that will take at least 1.5 years.
I have real estate in Israel worth approximately 800,000$.
Do you think by using these funds and investing them in a US business, I will be able to receive a conditional greencard faster than through my L1B?

Would you recommend taking a different approach than a EB-5 visa given our particular circumstances or should we sell everything we own in Canada and try to open a business in the states? 2. Does the way a person get a green card impart any restrictions on what that kind of activities/businesses/work that person can pursue after getting the green card.

4 Key changes to the EB-5 Regional Center Program:
Re-Starts Adjudication: The Act re-starts USCIS adjudication of pending I-526 petitions and pending I- 485 Adjustment of Status Applications based on approved I-526 petitions. The Act also re-starts Department of State (“DOS”) processing of approved I-526 petitions at the National Visa Center and U.S. Consulates. If you already have an initial I-526 approval please reach out to your immigration attorney to schedule your visa appointment.
5-Year Reauthorization: The EB-5 Program has been reauthorized for the next 5 years, through September 30, 2027. The 5-year reauthorization gives the EB-5 Program long-term stability. The Act provides express protection to EB-5 investors from a potential future lapse so there will be no future pauses in your EB5 process like the one you suffered from June 30th to March 11th.
Simultaneous Filing of Adjustment of Status: It is now possible to simultaneously file an I-526 petition together with an application for Adjustment of Status (Form I-485) with USCIS in the U.S. To be eligible for Adjustment of Status, applicants must hold lawful visa status in the U.S. Simultaneously filing the I-526 EB-5 green card petition with I-485 Adjustment of Status gives investors the possibility to live in the U.S. while awaiting USCIS adjudication of the I-526 petition. Adjustment of Status provides the investor and family with a temporary work permit and travel permit while awaiting adjudication. Simultaneous filing of Adjustment of Status is available to I-526 petitions that are already filed. Please reach out to your immigration attorney to see if you and your family qualify to live in the US while you await your I-526 approval.
Processing times: The Act requires USCIS to increase the pay of employees administering the EB-5 program, which opens the door towards additional staffing and faster processing of EB-5 cases. The fees associated to run an EB5 Regional Center have also increased considerably. These fees should help the USCIS to get the resources it needs to better execute the program. In this respect, the Act also requires an official evaluation of processing times to be done next year.
