[자막뉴스] "내가 직접 확인하겠다"...최서원 태블릿PC 반환 소송 승소 / YTN

법원 "최 씨 소유 확인…檢이 태블릿PC 돌려줘야"
최 씨 측 "검증 의뢰 예정…재심 청구도 고려"

최서원, 개명 전 최순실 씨의 국정농단 사건의 핵심 증거로는 태블릿PC가 꼽힙니다.

태블릿PC 안에서 대통령 연설문 등 국정 자료가 발견됐다는 보도가 이어지자 최 씨 측은 사건 초기부터 자신의 것이 아니라고 주장해왔습니다.

그런데 최 씨가 지난 1월 태블릿PC를 돌려달라며 국가를 상대로 소송을 냈습니다.

형사소송법상 증거물에 대한 몰수 선고가 없을 때는 압수가 해제된 거로 여겨지는 만큼 태블릿PC를 돌려받을 권리가 있다는 취지입니다.

최 씨 측은 재판에서 자신의 소유로 지목된 물건인 만큼 직접 받아서 확인을 해봐야겠다고 주장했습니다.

이에 검찰 측은 그동안 일관되게 연관성을 부인해온 최 씨에게 압수물을 돌려받을 권리가 있다고 보기 어렵다고 반박했지만 법원은 최 씨의 손을 들어줬습니다.

1심 재판부는 태블릿PC가 최 씨의 소유임을 확인한다며 검찰이 보관하고 있는 태블릿PC를 돌려주라고 판결했습니다.

판결 직후 최 씨 측은 전문기관에 검증을 의뢰해 실제로 최씨가 사용한 게 맞는지 확인할 예정이라며 재심 청구도 고려하고 있다고 말했습니다.

조카 장시호 씨가 특검에 제출한 이른바 제2의 태블릿PC에 대한 반환 소송은 아직 변론이 진행되고 있습니다.

검찰은 우선 1심 판결문 내용을 검토한 뒤 항소 여부를 결정하겠다고 밝혔습니다.
